Section 88
Even if the date is not settled after understanding the evidence
(1) Notwithstanding anything else written in this paragraph, if a party does not want to stay on the date after hearing the evidence, he may apply to the court for permission to do so.
(2) If an application is received according to sub-section (1), the court may cancel his date if it is not necessary to keep him on the date.
